Kimilili MCA David Barasa alias Webuye Juakali has been remanded at Bungoma GK Prison after Khalaba ward MCA Hon.Okumu Majimbo withdrew his bond surity.
Barasa and his driver Brian Lihanga had been arraigned in court for obtaining Sh206k through false pretense from a Nairobi business lady.
The court had slapped the duo with Sh100,000 bond or Sh100,000 cash bail each.
February 13, 2020 was a mentioned date and Majimbo withdrew his bond support citing lack of commitment from Hon.Barasa to settle the matter outside the court.
Majimbo told the court that even after freeing Barasa on bond he had failed to find a way of also freeing his driver who is languishing in the correctional facility.
“I don’t want to be an accomplice in this matter because Barasa lacks commitment to settle the matter outside the court with the complainant and doesn’t also value his driver, let the court decide,” he told the court.
Majimbo also said that the accused lawyer Brian Khaemba was not also committed to help find a lasting solution between the two parties.
Barasa and Lihanga were charged at the Bungoma law court on January 30, 2020.
The court was told that the duo conned a Nairobi based business lady Harriet Abula.
“The accused persons took Sh206,000 from the business lady with the promise of instituting an impeachment motion against the West Nalondo MCA Erick Wapang’ana who is said to have also defrauded the complainant,” read the charge sheet.
The accused person are believed to have received the cash from the complainant on diverse dates between January 6-9, 2020 at Kimilili township.
