A youth and a total orphan who stole a cock in a bid to sell it and buy food was arraigned in court.
The accused Brian Simiyu (22) was charged with stealing a cock valued at Sh1,200 from its owner Patrick Onyango in Ekitale trading centre in Kanduyi constituency.

The accused person pleaded guilty to the offense and told the court that he broke into the complainant’d chicken house and stole the cock after he felt hungry and wanted to sell it and buy food because he is a total orphan.
He was also charged with another count of handling stolen property.
The court was told that the accused person committed the offense on April 22, 2020 at about 10:30am.
The court was told that a Nyumba kumi official Martin Sungura arrested the accused person at bus park estate on Khaoya junction after a tip off from members of the public.
He was informed that a youth who was sispected to have stolen the cock and was looking for a buyer.
He had convinced George Achieng and was about to sell the cock to him when he was arrested.
“When he was interrogated he said he had bought it from a certain man but when they followed up they realized it was a lie.
Appearing before resident magistrate Gabriel Omondi the accused person with the court to set him free because it wasn’t his intention to steal but he was driven by hunger.

“Your honour just set me free so that i can repay the owner his chicken back, it is poverty that drove me to steal because i am a total orphan having lost all my parents,” said Simiyu.
He told the court that he could afford to pay the complainant Sh1500 if he is released.
Omondi ordered the accused person to pay the complainant Sh2,000 or serve a thirty days in prison.
The court ordered the cock returned the to the owner.
